The first case under scrutiny involves an AI-generated nude image of an Indian public figure posted on Instagram. Despite user reports, Meta failed to promptly remove the image, allowing it to persist on the platform. Only after the user appealed to the Oversight Board did Meta take action, citing a breach of community standards on bullying and harassment. The second case concerns a similar incident on Facebook, where an explicit AI-generated image resembling a U.S. public figure was posted in an AI creations group. While Meta swiftly removed the image, the board selected this case to examine broader issues in Meta’s content moderation policies.

The board’s selection criteria, according to co-chair Helle Thorning-Schmidt, aim to assess Meta’s global effectiveness in protecting users, particularly women, from harmful content. By analyzing cases from different regions, such as the U.S. and India, the board seeks to evaluate the fairness and consistency of Meta’s enforcement practices worldwide.

Challenges of Deepfake Porn and Gender-Based Violence Online

Generative AI tools have enabled the creation of deepfake porn, presenting ethical dilemmas and exacerbating online gender-based violence. In countries like India, the proliferation of deepfakes, particularly targeting women, has raised significant concerns. Despite discussions around enacting legislation to address deepfake-related offenses, challenges persist in enforcing existing laws and supporting victims of online harassment.
